Use of Elbaab Services
Terms and Conditions
These Terms and Conditions govern access to and use of Elbaab websites, applications, portals, order flows, communications, and related services. By using Elbaab, you agree to these terms.
1. Acceptance and scope
By accessing or using Elbaab websites, applications, portals, communications, or related services, you agree to these Terms and Conditions. If you do not agree, you must not use the service.
- These terms apply to browsing, account registration, ordering, supplier activity, courier or rider activity, support interactions, and related use of the platform.
- They operate together with the Elbaab Privacy Policy and any mandatory legal rights or obligations that apply under law.
- If you enter into a separate written agreement with Elbaab for business or operational services, that agreement may supplement or override these terms to the extent of any direct conflict.
2. Eligibility and accounts
You must provide accurate information, keep your account credentials secure, and use Elbaab only for lawful and authorized purposes. Business users must be authorized to act for the shop, company, branch, or delivery business they represent.
- Supplier, courier, rider, and other business-facing accounts are intended for adults and authorized representatives who are legally able to enter binding arrangements.
- You may not impersonate another person, create unauthorized duplicate accounts, share credentials, or misrepresent your identity or role.
- Elbaab may request verification, moderation materials, or additional information before activating, restoring, or continuing some accounts.
3. Elbaab platform role
Elbaab provides a technology and operational coordination platform for digital commerce, fulfilment, and support. Unless Elbaab expressly states otherwise for a specific flow or contract, Elbaab is not automatically the seller, manufacturer, or common carrier for supplier-listed goods.
- Suppliers remain responsible for the legality, accuracy, quality, availability, pricing, and fulfilment readiness of their own products, shops, and submissions.
- Couriers and riders remain responsible for lawful delivery conduct, operational compliance, and accurate execution of delivery tasks.
- Elbaab may provide tools, communications, moderation, support, payment-flow integration, and operational oversight without assuming every obligation of a supplier, courier, or other third party.
4. Orders, availability, and pricing
Product listings, availability, estimated fulfilment times, delivery windows, prices, and related order information may change because of supplier updates, operational constraints, fraud checks, technical issues, inventory limits, legal requirements, or service availability.
- Order placement does not guarantee that an item will remain available, that a specific timeline will be met, or that every transaction will be accepted or completed in all cases.
- Elbaab may reject, cancel, limit, or modify transactions where reasonably necessary for operational, legal, technical, security, fraud-prevention, or policy reasons.
- Specific categories, products, suppliers, promotions, or locations may be subject to additional restrictions, fees, or service conditions.
5. Payments, refunds, and cancellations
Payments, refunds, cancellations, withdrawal flows, delivery charges, taxes, and related financial actions may be affected by platform rules, supplier obligations, bank or processor rules, and applicable law. External payment or payout providers may process part of these flows.
- You are responsible for reviewing amounts, charges, and transaction details before confirming a purchase or other financial action.
- Refunds, cancellations, failed payments, supplier withdrawals, and related service actions may be subject to fraud review, identity verification, operational checks, and provider or legal requirements.
- Elbaab may delay, refuse, reverse, or hold certain financial actions where fraud, compliance, identity, contractual, or technical concerns require intervention.
6. Supplier obligations
Suppliers are responsible for the accuracy, legality, completeness, and timeliness of their business information, shop information, product listings, prices, stock positions, moderation materials, fulfilment performance, and customer-facing communications.
- Suppliers must ensure that products, descriptions, images, availability, and pricing are accurate and lawful.
- Suppliers must comply with applicable law, marketplace rules, tax and pricing obligations, and customer-service commitments communicated through Elbaab.
- Elbaab may reject, return, suspend, remove, or limit supplier submissions or accounts that are incomplete, inaccurate, unlawful, unsafe, misleading, or otherwise non-compliant.
7. Courier and rider obligations
Couriers and riders must comply with delivery, safety, account-use, and operational requirements communicated by Elbaab. They must act honestly and must not falsify delivery activity, manipulate assignments, or misuse location, communication, or account flows.
- Couriers and riders must keep required onboarding, business, vehicle, and operational information current.
- They may not share accounts, misrepresent delivery status, or engage in unsafe, fraudulent, abusive, or policy-violating conduct.
- Operational failures, safety violations, fraud, or policy breaches may result in restriction, suspension, or termination.
8. Prohibited conduct
You may not use Elbaab to engage in unlawful, fraudulent, abusive, harmful, or misleading conduct or to upload, sell, distribute, or promote restricted goods, prohibited content, or infringing material.
- Examples include impersonation, fraud, rights infringement, harassment, malware, abuse of communications or refund flows, and attempts to bypass moderation, security, or access restrictions.
- You may not interfere with platform availability, scrape or misuse data, exploit system behavior in bad faith, or use the service in a way that harms Elbaab or other users.
- Elbaab may investigate, restrict, report, remove, or terminate content, transactions, accounts, or access where prohibited conduct is suspected.
9. Intellectual property and content
Elbaab and its licensors retain rights in the platform, software, designs, branding, interfaces, and related materials, except where third-party or user-owned content is involved. Users remain responsible for content they submit and must have the rights needed to provide it.
- You may not copy, reverse engineer, scrape, reproduce, republish, or commercially exploit the platform except where law or our written permission allows it.
- By submitting content to Elbaab, you grant Elbaab a non-exclusive, worldwide, royalty-free right to host, store, reproduce, format, display, transmit, and otherwise use that content as needed to operate, secure, moderate, and improve the service.
- Elbaab may remove or disable content that appears unlawful, infringing, unsafe, misleading, or otherwise non-compliant.
10. Communications and notices
Elbaab may send transactional and service-related communications, including account-verification emails, password-reset emails, order and delivery updates, moderation notices, support messages, security alerts, and operational notifications.
- Service communications may be sent by email, in-app notice, push notification, WhatsApp, SMS fallback, or other channels used for platform operation and account security.
- You are responsible for keeping your contact information current enough to receive important service communications.
- Marketing communications, if any, are separate from necessary service and security communications and may be subject to additional consent or unsubscribe rules where required by law.
11. Suspension and termination
Elbaab may suspend, restrict, return, reject, deactivate, or terminate accounts, listings, moderation items, transactions, or service access where reasonably necessary for legal, policy, security, safety, fraud, technical, operational, or contractual reasons.
- These actions may affect ongoing orders, withdrawals, payouts, moderation history, and access to certain service features.
- Elbaab may preserve records needed for legal compliance, fraud review, audit, dispute handling, or operational continuity even after suspension or termination.
- Where appropriate, Elbaab may permit correction, re-submission, appeal, or reinstatement, but it is not required to do so in every situation.
12. Disclaimers
The platform is provided subject to availability, operational limits, third-party dependencies, and lawful restrictions. To the fullest extent permitted by law, Elbaab disclaims warranties that are not expressly stated.
- Elbaab does not guarantee uninterrupted availability, error-free performance, or outcomes beyond its reasonable control.
- Listings, delivery estimates, payment flows, notifications, and support outcomes may be affected by suppliers, couriers, riders, banks, processors, third-party services, user conduct, connectivity, moderation, fraud checks, or legal restrictions.
- Nothing in these terms excludes or limits rights that cannot be lawfully excluded under applicable law.
13. Limitation of liability
To the fullest extent permitted by law, Elbaab will not be liable for indirect, incidental, special, consequential, punitive, or business-related losses arising from use of the platform, platform downtime, user conduct, third-party services, or transaction disputes.
- This limitation applies only to the extent permitted by applicable law and does not exclude liability that cannot be excluded or limited by law.
- Where the law permits a monetary cap, Elbaab's total liability for claims arising out of or relating to the service will not exceed the amount paid by the relevant claimant to Elbaab for the specific transaction or service giving rise to the claim during the twelve months preceding the event giving rise to the claim.
- Liability of suppliers, couriers, riders, payment providers, or other third parties may be governed by their own legal obligations or agreements.
14. Governing law and disputes
These Terms and Conditions are governed by the laws of the United Arab Emirates. Unless mandatory law requires another forum, any dispute arising out of or relating to Elbaab or these terms will be submitted to the competent courts of the United Arab Emirates.
- Before starting formal proceedings, you should contact Elbaab at support@elbaab.ae and allow a reasonable opportunity to resolve the issue informally.
- If mandatory consumer, employment, or regulatory rules provide a different dispute route or non-waivable rights, those rules will control to the extent required by law.
- Urgent interim relief or mandatory regulatory remedies may still be sought in the forum allowed by law.
15. Changes to the terms
Elbaab may update these Terms and Conditions from time to time to reflect service changes, legal requirements, operational changes, or policy improvements. Updated terms will be published on this page with the revised date.
- Material changes may also be highlighted in-product, by email, or through other appropriate communication channels.
- Your continued use of Elbaab after a lawful update process may constitute acceptance of the revised terms where permitted by law.
- If you do not agree to an updated version, you should stop using the affected services.
